These Terms of Use ("Terms") govern your access to and use of RegViento Explorer
(the "Service"), operated by MesH Engineering GmbH, Ulrichstraße 23,
73230 Kirchheim/Teck, Germany ("we", "us", or "the operator"). By registering
for or using the Service you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

By creating an account or using the Service, you confirm that you have read,
understood, and agree to these Terms. If you do not agree, you must not register
or use the Service.

The Service is currently provided free of charge. We reserve the right to
modify, suspend, or discontinue the Service, in whole or in part, at any time;
material changes to these Terms are handled as described in Section 13.

2. ELIGIBILITY

You must be at least 18 years of age to use this Service. By registering, you
confirm that you meet this requirement.

3. USER ACCOUNTS

You are responsible for:
- Keeping your login credentials confidential and not sharing them with others.
- All activity that occurs under your account.
- Notifying us promptly of any suspected unauthorised use of your account.

You may not transfer your account to any other person. We reserve the right to
require password changes or suspend accounts that appear to be compromised.

4. ACCEPTABLE USE

You agree to use the Service only for lawful purposes. You must not:
- Violate any applicable local, national, or international laws or regulations.
- Infringe the intellectual property or other rights of any third party.
- Attempt to gain unauthorised access to any part of the Service or its systems.
- Use the Service to transmit harmful, fraudulent, or illegal content.
- Reverse-engineer, decompile, or otherwise attempt to extract the source code.
- Use automated means to access the Service in a way that imposes an unreasonable
load on its infrastructure.

5. CALCULATION RESULTS: IMPORTANT DISCLAIMER

The Service provides estimates of wind farm wake losses and potential power gains
using simplified aerodynamic models (including the Jensen top-hat wake model and
Jiménez deflection). These calculations are indicative only.

Results produced by the Service:
- Are based on publicly available reference data and simplified assumptions.
- May differ materially from results produced by certified engineering software
or site-specific analysis.
- Are NOT suitable as the sole basis for investment, financing, permitting, or
engineering decisions.
- Must be independently verified by a qualified wind energy engineer before
being relied upon for any professional or commercial purpose.

The operator accepts no liability for losses or damages arising from reliance on
calculation results produced by this Service.

6. THIRD-PARTY DATA SOURCES AND SERVICES

The Service incorporates data and services from the following third parties.
By using the Service you acknowledge and agree to the following:

a) Map data and imagery are provided by OpenStreetMap contributors
(© OpenStreetMap contributors, available under the Open Database Licence,
odbl.opendatacommons.org), Esri and its data suppliers (satellite imagery),
and OpenTopoMap. Use of these data is subject to their respective terms and
licences.

b) Wind turbine reference data includes the NREL 5 MW reference turbine
specification, originally published by the National Renewable Energy
Laboratory (NREL), now the National Laboratory of the Rockies (NLR), and
made available by Alliance for Energy Innovation LLC under the Apache 2.0
licence (apache.org/licenses/LICENSE-2.0).

c) Turbine library data is sourced from the Open Energy Platform (OEP,
openenergyplatform.org) via its public API. Use of OEP data is subject to
OEP's data terms and the licences of the individual datasets.

d) Wind resource data may be fetched from the NASA POWER API
(power.larc.nasa.gov), a public data service provided by the National
Aeronautics and Space Administration (NASA) of the United States. Use of
NASA data is subject to NASA's open data policies.

e) Location search and wind turbine location data are provided via Nominatim
and the Overpass API, both services based on OpenStreetMap data.

f) Optional sign-in is offered via Google (Google Ireland Limited, Gordon
House, Barrow Street, Dublin 4, Ireland) and Microsoft (Microsoft Ireland
Operations Limited, One Microsoft Place, South County Business Park,
Leopardstown, Dublin 18, Ireland). If you choose to sign in with one of
these providers, identification data (such as your e-mail address, name,
and a provider account identifier) is exchanged between your browser, the
provider, and the Service. The provider processes your data under its own
privacy policy.

When you use features that rely on these services, your browser will transmit
requests, including your IP address and query parameters, directly to the
respective third-party servers. These transmissions are processed by those third
parties in accordance with their own privacy policies, over which the operator
has no control. The operator accepts no responsibility for the availability,
accuracy, or conduct of any third-party service.

7. DATA STORAGE AND PRIVACY

a) Account data: When you register, we store your email address, chosen
username, hashed password (or OAuth identifier), two-factor authentication
secret (only if you enable two-factor authentication), and account
preferences in a database hosted by IONOS SE in Germany. Messages you send
or receive via the Service's internal messaging function are stored in the
same database and are deleted automatically together with your account.

b) Wind farm data: Turbine layouts, wind rose configurations, and calculation
results are stored locally in your browser's local storage. By default this
data does not leave your device. It is transmitted only when you actively
trigger a function that requires it: when the server-side calculation
service is enabled, running a calculation sends your farm layout and wind
data to our server, which forwards them to the calculation service for
processing; the data is used solely to perform the calculation and is not
stored beyond the duration of the request. Export and download functions
likewise process your data only at your request. If you use the "Detailed
Analysis Request" function, your message together with your farm
configuration and simulation results is transmitted to us by e-mail so
that we can respond to your request.

c) Cookies and local storage: The Service uses strictly necessary cookies
(a session cookie to keep you signed in and a CSRF protection cookie) and
your browser's local storage (to save your wind farm inputs, wind rose
data, calculation results, and interface preferences on your device).
These are technically required to provide the Service; no advertising,
tracking, or analytics cookies are used, and no consent banner is
therefore required.

d) Logs: We retain server-side administrative logs for up to 90 days.

e) Rights under GDPR: Under the General Data Protection Regulation (GDPR), you
have the right to access, rectify, erase, restrict processing of, or receive
a portable copy of your personal data. To exercise any of these rights,
please contact us at the address in Section 16. You also have the right to
lodge a complaint with a data protection supervisory authority, in particular
in the EU member state of your habitual residence, place of work, or place of
the alleged infringement.

f) Our Privacy Policy sets out in full how we collect, use, and protect your
personal data. It is available at any time within the Service (see the
"Privacy Policy" link in the page footer) and on request via the contact
details in Section 16.

8. COMMUNICATIONS

a) Service communications: We may send you transactional emails related to your
account, including registration confirmation, password reset messages,
security notifications (for example when a new sign-in method is linked to
your account), and important service notices. These communications are
necessary for the operation of the Service.

b) Marketing and advertising communications: We will only contact you with
marketing, promotional, or advertising messages if you have given your
explicit and separate consent, either via the optional checkbox at
registration or later in your account settings. Consent is entirely
voluntary and independent of your acceptance of these Terms. You may
withdraw consent at any time in your account settings, by using the
unsubscribe link in any marketing email, or by contacting us at the
address in Section 16. Withdrawal of consent does not affect the
lawfulness of communications sent before the withdrawal.

9. INTELLECTUAL PROPERTY

The design, source code, and proprietary content of the Service are the property
of the operator and are protected by applicable intellectual property laws.
Third-party data, libraries, and components used in the Service are subject to
their respective licences as described in Section 6.

You retain ownership of the data you input into the Service. You grant the
operator a limited licence to process that data solely for the purpose of
providing the Service to you.

10. TERMINATION

We reserve the right to suspend or terminate your account at any time if you
violate these Terms or for any other legitimate reason. We will endeavour to
give notice where practicable. Upon termination, your right to use the Service
ceases immediately.

You may delete your account at any time directly in your account settings, or
request deletion by contacting us at the address in Section 16.

11. DISCLAIMER OF WARRANTIES

The Service is provided "as is" and "as available" without warranties of any
kind, either express or implied, including but not limited to warranties of
merchantability, fitness for a particular purpose, or non-infringement. We do
not warrant that the Service will be uninterrupted, error-free, or secure. See
also Section 5 regarding calculation results.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the operator shall not be
liable for any indirect, incidental, special, consequential, or punitive damages
arising from your use of, or inability to use, the Service, including but not
limited to loss of profits, loss of data, or business interruption.

Nothing in these Terms limits or excludes liability for death or personal injury
caused by negligence, for fraudulent misrepresentation, or for any other
liability that cannot be excluded by law.

13. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. We will notify
registered users of material changes by email or via an in-app notice at least
14 days before the changes take effect. Your continued use of the Service after
changes take effect constitutes your acceptance of the revised Terms.

14. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that
provision shall be modified to the minimum extent necessary to make it valid and
enforceable. The remaining provisions shall continue in full force and effect.

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of the
Federal Republic of Germany and applicable European Union law, without regard to
conflict-of-law provisions. If you are a consumer habitually resident in the
European Union, you additionally enjoy the protection of any mandatory
provisions of the law of your country of residence.

For users who are merchants (Kaufleute), legal entities under public law, or
special funds under public law, the exclusive place of jurisdiction for all
disputes arising under or in connection with these Terms is Stuttgart, Germany.
